BIO MINISTAR KRAJINE, SADA TRAŽI H RVATSKU MIROVINU.
BIVŠI ministar prometa i veza u vladi tzv. SAO Krajine, a danas član Vučićeve Srpske napredne stranke (SNS) i monter PVC stolarije u Pančevu, Savan Grabundžija (68) pokrenuo je pravnu bitku kako bi ostvario pravo na mirovinu Hrvatskog sabora.
Kada sam ovo pročitao, mislio sam da je neka zajebancija, jer tu smo vrhunski majstori. Nažalost, istina je. Pa se pitam, tko je ovdje lud, obzirom da je naš Ustavni sud, držeći se čvrsto zakona, stao na stranu Grabundžije, ukinuo ranije presude i rješenja, te je predmet vratio HZMO-u na ponovno razmatranje. Stvarno kod nas vrijedi, da prostite, ona stara- „Jebe lud zbunjenog“
Grabundžija je na početku demokratskih promjena devedesetih izabran kao predstavnik Saveza komunista Hrvatske - Stranke demokratskih promjena (SKH-SDP) u Vijeće općina sabora Republike Hrvatske, tijelo koje je okupljalo predstavnike lokalnih jedinica i kojim je predsjedao Slavko Degoricija.
Nije dolazio na sjednice od prosinca 1990., kasnije i formalno izašao iz sabora i posao ministar tzv. vlade Krajine. Svejedno traži saborsku mirovinu
Međutim, Grabundžija je s ostalim predstavnicima Srba prestao dolaziti na sjednice u prosincu 1990. godine. Mjesec dana kasnije, 31. siječnja 1991. Grabunžija je s grupom zastupnika formalno obavijestio sabor o prekidu svojeg sudjelovanja u radu sabora te se pridružio političkim strukturama samoproglašene paradržave SAO Krajine, gdje je ubrzo postao ministar u njezinoj vladi. Unatoč tome, Grabundžija sada traži mirovinu na temelju zastupničkog mandata u Hrvatskom saboru.
Nakon što mu Hrvatski zavod za mirovinsko osiguranje (HZMO) odbija zahtjev za mirovinu, Grabundžija se obraća Upravnom sudu u Zagrebu, ali gubi i taj spor. Visoki upravni sud također odbacuje njegovu žalbu. No, situacija se mijenja kada se Grabundžija obraća Ustavnom sudu Republike Hrvatske, tvrdeći da je bio diskriminiran po nacionalnoj osnovi. Ustavni sud presuđuje u njegovu korist, otvarajući time mogućnost da bivši član "odmetnutih" saborskih zastupnika, koji je obnašao funkciju u paradržavnoj vlasti, sada ostvari pravo na hrvatsku saborsku mirovinu.
Odluka Ustavnog suda posebno je zanimljiva s obzirom na to da je Grabundžija velik dio svojeg mandata za koji traži mirovinu proveo izvan okvira legitimnih hrvatskih institucija. Štoviše, bio je u strukturama koje su djelovale protiv ustavnog poretka Republike Hrvatske.
Odluku je još krajem rujna donijelo vijeće Ustavnog suda kojim je predsjedala Ingrid Antičević Marinović, a u njemu su bili još Mato Arlović, Snježana Bagić, Josip Leko, Davorin Mlakar i Miroslav Šumanović.
S kojim je obrazloženjem Ustavni sud srušio ranije presude
Ustavni sud je utvrdio da upravni sudovi i HZMO nisu pružili dovoljno ozbiljna, relevantna i dostatna obrazloženja svojih odluka te da su svojim postupanjima povrijedili Grabundžijino ustavno pravo na pravično suđenje.
Sud je naglasio da se obnašanje dužnosti zastupnika ne može automatski povezati s prisustvovanjem sjednicama jer niti jedan zakon nije propisivao takav uvjet. U prilog Grabundžiji išla je i potvrda Hrvatskog sabora, koja je priznala da je Grabundžija formalno imao zastupnički mandat u navedenom periodu, bez obzira na neaktivnost na sjednicama.
Prema mišljenju Suda, upravna tijela i sudovi nisu smjeli jednostavno izjednačiti nepojavljivanje na sjednicama s prestankom obnašanja zastupničke dužnosti, već su trebali uzeti u obzir cjelokupno trajanje Grabundžijinog mandata.
Posebnu težinu, po Ustavnom sudu, ima potvrda koju je izdao Hrvatski sabor, a kojom se priznaje da je Grabundžija formalno bio zastupnik od svibnja 1990. do rujna 1992. Ustavni sud smatrao je da su tijela koja su odbila njegov zahtjev za mirovinu zanemarila tu potvrdu i zakonske odredbe koje nisu predviđale automatski prestanak mandata zbog nepojavljivanja na sjednicama
Novim Ustavom iz 1990. godine mandati zastupnika postali su neobvezujući, a taj je kontekst, prema Sudu, također bio ključan u ovom slučaju.
Budući da su upravna tijela i sudovi odlučivali isključivo na temelju prisustva na sjednicama, bez dodatnih objašnjenja, Ustavni sud zaključio je da takvo postupanje nije pošteno prema Grabundžiji te je povrijeđeno njegovo pravo na pravično suđenje.
Odluka otvara novu mogućnost ministru tzv. SAO Krajine da dobije hrvatsku saborsku mirovinu
Ovom odlukom Ustavni sud nije donio konačnu presudu u Grabundžijinom slučaju, već je ukinuo ranije presude i rješenja te je predmet vratio HZMO-u na ponovno razmatranje.
Time se otvara mogućnost da Grabundžija ipak ostvari pravo na saborsku mirovinu / 1900 eura / unatoč tome što je velik dio mandata proveo izvan hrvatskih institucija, služeći u paradržavnim strukturama koje su djelovale protiv ustavnog poretka Republike Hrvatske.
